Man wins 'right to have crime forgotten' against Google


Justice Mark Warby of the High Court of England and Wales ruled in favor of a businessman who'd asked Google to remove search results related to a past criminal conviction.

The judge ruled out any damages payment, and told the court: NT2 has frankly acknowledged his guilt and expressed genuine remorse. "The information is of scant if any apparent relevance to any business activities that he seems likely to engage in".

The ruling pointed out that this father-of-four didn't profit financially from the violations and was at risk of losing his job again unless the articles were brought down in search results with his name.

As reported at the Guardian, the businessman who won was sentenced to six months' imprisonment for "conspiracy to carry out surveillance" and a judge ruled an "appropriate delisting order should be made" in this case. In those circumstances, "the public interest in having information with his name about this case doesn't prevail".

Commenting on Friday's decision, Jim Killock, executive director of the Open Rights Group said: "The right to be forgotten is meant to apply to information that is no longer relevant but disproportionately impacts a person". The right of people to rehabilitation is an important one.

"There is an inherent tension between an individual's right to privacy and what information the public interest requires be available", said solicitor Ben Rose, who is based at law firm Hickman & Rose.

Google says it will accept the rulings from the judge.

As Engadget noted, the London high court ruling could force internet companies to not immediately dismiss conviction-related delisting requests. Some advocates celebrated the court's decision, calling it a win for people with criminal records who face discrimination due to their past misdeeds.

At the heart of the precedent-setting disputes is a balancing act between the right to a private life and the right to freedom of expression, both of which were established in the European Convention on Human Rights.

Though European Union citizens have a legal right to request that search engines delist certain negative results about them, Google reportedly refuses over 56 percent of requests. Some free speech advocates have argued that could infringe upon the U.S. Constitution.
