Micron says China ban unfair but won't hurt revenue

Semiconductors are among China's biggest imports rivalling oil

When violations occur, UMC stands ready pursue patent infringement litigation in order to obtain judgment and remedies to protect the intellectual property rights of the company.

The company also confirmed in a statement for the first time two of its units had been temporarily banned from selling some memory chips and solid state drives in China, following a complaint from rivals United Microelectronics Corporation (UMC) and Fujian Jinhua Integrated Circuit Co.

In December, Micron introduced a lawsuit in United States District Court for the Northern District of California that accused UMC of stealing trade secrets and giving the technology to Jinhua. The lawsuit covers three areas, including specific memory applications and memory used in graphics cards.

Micron said it has not been served with an injunction and would not comment further until it has received and reviewed court documentation. Jason Wang, co-president of UMC, stated, "UMC is pleased with today's decision".

In January 2018, UMC and Jinhua filed patent infringement suits in Fujian Province, China against Micron's China subsidiaries. "And the stakes are high, as we can see in this case". Moore pointed out that the $42 million in damages requested by UMC are minimal compared to Micron's $32 billion revenue run rate.

China is the largest market that accounts for 65% of world semiconductor trade.

UMC shares rose as much as 3.9 percent on Wednesday, before erasing a chunk of the gains to be up 1 percent.

It also resells flash memory products purchased from other suppliers. Because China cannot replace Micron's supply of chips with its own domestically produced chips, this could ultimately lead to a reversal of the court's ban, according to an unnamed official in South Korea's semiconductor industry, in an interview with South Korean news portal Business Korea.

China represents about one quarter of the worldwide sales of memory chips, while half of the revenue generated by Micron is from sales in China, with an additional 12.5% from sales of chips in Taiwan. If the ban is enacted, Micron's competitors, including Samsung, SK Hynix, WDC, Intel, Toshiba and the new entrant YMTC would be benefited.

However, sources close to the company say it is now drafting a response to the ruling by the Fuzhou Intermediate People's Court of the People's Republic of China.

The delay in approving the deal has coincided with uncertainty over the fate of Chinese smartphone and telecommunications company ZTE.
