Democrats' long-shot plan to stop Trump's Supreme Court pick

The seat, vacated by retiring justice Anthony Kennedy, is expected to be filled in the coming months with Trump set to announce his nominee tonight at 9:00 PM.

After days of frenzied lobbying and speculation, President Trump announced Brett Kavanaugh on Monday as his second nominee to the Supreme Court, setting up a ferocious confirmation battle with Democrats as he seeks to shift the nation's highest court farther to the right. "And just like Justice Gorsuch, he excelled as a legal clerk for Justice Kennedy", Trump added.

Trump is said to have apparently lost interest in Kethledge.

"President Trump is now a subject of an ongoing criminal investigation, and any nomination of a Supreme Court justice while that investigation continues is unacceptable because of the clear conflict of interest inherent in the President installing someone who could be the deciding vote on a number of potential issues from that investigation that could come before the Court", Booker added. "A judge must interpret statutes as written and a judge must interpret the constitution as written", Kavanaugh said during the ceremony in which he underscored his ties to his family and his Roman Catholic faith.

At Monday night's announcement in the East Room, Judge Kavanaugh, 53, said: "Mr President, thank you". The official said Trump decided on Kavanaugh because of his large body of jurisprudence cited by other courts, describing him as a judge that other judges read.

Kethledge, a graduate of the University of Michigan Law School, is a former Kennedy clerk and a former in-house lawyer at Ford Motor Co. Top contenders had included federal appeals judges Raymond Kethledge, Amy Coney Barrett and Thomas Hardiman.

Trump called Kavanaugh "one of the finest and sharpest legal minds of our time", saying he is "considered a judge's judge and a true thought leader among his peers". Republicans now hold a 51-49 majority, but Senator John McCain (R-Arizona) is battling brain cancer and is unlikely to be present for a vote.

Liberal groups have geared up to protect Roe v. Wade, the Supreme Court case that upheld women's rights to an abortion, from being overturned. Kennedy provided a decisive vote in 2015 on an important fair housing case. She considers federal appeals from Wisconsin, Indiana and IL and hears the cases in the Dirksen Federal Building courthouse in Chicago's Loop. While many of their Democratic colleagues are already vowing to oppose Kavanaugh, these senators put out far more tepid statements. Kavanaugh in 2009 changed his tune on the Starr probe, arguing that presidents should be free from civil lawsuits, criminal prosecutions and investigations while in office. That view has particular relevance as special counsel Robert Mueller is looking into Russian meddling in the 2016 election and whether the Trump campaign played any role in a foreign interference plot. In a recent case involving abortion and immigration, he wrote a decision that temporarily barred a pregnant teenager in immigration custody from obtaining an abortion. The court's ruling in her favor was based on a constitutional principle, he wrote, "as novel as it is wrong: a new right for unlawful immigrant minors in U.S. Government detention to obtain immediate abortion on demand".

During an appearance on MetroNews "Talkline", Capito said she wants Trump to nominate a judge similar to Gorsuch, who she voted to confirm a year ago.
