Federal judge halts mother-daughter deportation

Judge orders government to turn around deportation plane

As a federal judge heard arguments on Thursday seeking to halt the deportations of several Central American women requesting asylum, he learned that a woman and her daughter at the center of the case had been ushered from a Texas shelter, driven to an airport and put on a plane to El Salvador.

The lawsuit brought by the ACLU is challenging a recent decision by Sessions to make it almost impossible for victims of domestic violence and gangs to qualify for asylum in the US. 'I'm also directing the government to turn that plane around, either now or when it lands.

The judge expressed outrage, ordering the plane be turned around, suggesting the government be held in contempt starting with the attorney general, and saying it was "unacceptable" that someone in pursuit of justice who has alleged a credible fear in a USA court is spirited away while her attorneys argue for her in court. "This is not acceptable". "That someone seeking justice in US court is spirited away while her attorneys are arguing for justice for her?" he said.

Sullivan then threatened to hit Sessions with contempt, saying that if the immigrants weren't returned he was going to order officials to explain "why people should not be held in contempt of court, and I'm going to start with the attorney general".

The attorney for the US DOJ, Erez Reuveni, could not confirm where Carmen and her daughter actually were at the time.

Under that policy, which came in the form of a new legal precedent Mr. Sessions issued in June, asylum-seekers can no longer argue that domestic abuse or gang violence in their home countries is sufficient to get on the asylum track.

During the hearing, the judge ordered a temporary stay on deporting the nine women and three children who filed the lawsuit, according to a court filing.

Mr. Sessions also ruled the asylum-seekers must prove their home governments either actively encouraged their persecution, or were so incapable that they were culpable.

"Carmen's husband routinely raped and treated her as property, even after they live apart from each other". But they did not disembark and the plane immediately headed back to Texas, the DHS official said.

She never reported the threats to the police because she believed police did not protect women in El Salvador.

The number of immigrants who didn't pass credible fear screenings rose in June, according to new statistics the government released Tuesday.

The American Civil Liberties Union had filed the suit with two of its local affiliates and the Center for Gender & Refugee Studies.

The litigation known as Grace v. Sessions, debates that policies framed against American and worldwide laws that concede gender specific oppression as premise for asylum and they instinctually preserve the process is supposed to provide.

She also says four of her five co-workers were killed by a gang over the previous year, and she fears she's next.

The lawsuit, known as Grace v. Sessions, argues that the policies cut against American and global laws that recognize gender-based persecution as grounds for asylum and that they gut the protections the process is supposed to offer.
